Exploring Boundaries: A Discourse on Freedom of Artistic Expression in Photography and Digital Contents (Visual media) Tanzania

The effect of the development of science and technology resulted in massive use of the internet whereas the art industry evolved into new practices. It is when art emerged in content creation as a new form of art. Since our laws are developing slowly compared to the ongoing changes, they failed to comprehend the existing art environment. Evidently, new forms of digital art are circulating on the internet space, like social media, websites, digital stores, etc. Such kinds of digital art are audiobooks, story-telling, music, animations, audio-visual, visual art, graphic designs, photography, etc.

 

The existing laws in the arts and cultural sector have not yet been reviewed and amended to cover the prevailing changes.  In carefully scrutinization of stakeholders they realized that not every content creation is art. They conceded collectively that some content creations are art while others are modes of public communication. e.g. Journalism, politics, sports, entrepreneurship, etc. The current legal regime does not recognize the part of content creation with an artistic nature as “art ”.
